The page lumicroma.com is owned by Sandra Maria Teixeira Unipessoal, Lda, a Portuguese private company, with registered office at Rua do Freixo, 1071, Sala 6 - 4300-218 Porto, VAT o. 513597549 and registered in the Commercial Register under the same number, which uses the trade name Lumicroma and is also a European trademark registered in EUIPO - European Union Intellectual Property Office, owned exclusively by the same company.

These Terms and Conditions (hereinafter jointly referred to as the "Conditions") set out the rules for access to and use of Lumicroma's website (hereinafter referred to as the "Website"), the use of which presupposes acceptance of and compliance with the terms set out below.

Should the user have any reservations, doubts or objections in relation to the Conditions, the user must immediately suspend access to and use of the Website, leaving it and refraining from further use.

Lumicroma reserves the right to alter, add or delete the Conditions, without prior notice, with any such alterations taking effect after they have been posted on the website.
 

In the use of the Website, the user undertakes, in particular, to:

(a) To respect the copyright and intellectual property rights of Lumicroma and its users;

(b) To make correct and appropriate use of the Website and its contents, in accordance with these Conditions, refraining from any use which may be considered harmful to Lumicroma, its users or any other third parties;

(c) Not to modify the software of the Website with the aim of obtaining unauthorised access to any of its contents.

Lumicroma reserves the right to monitor the use of the Website in order to detect any misuse and to supervise compliance with these Conditions.

The Website contains or may contain text, comments, messages, information, graphics, photographs, informative articles, illustrations, software, audio and video (which shall be referred to as "contents") which may only be accessed and used subject to the unreserved acceptance of these Conditions.

Without prejudice to that referred to in this section, any modification, copying, distribution, transmission, publication, licensing or creation of new content based on those available on the Website, regardless of their nature and purpose, which integrate, in part or in full, the contents of the Website, without prior written permission of Lumicroma is strictly prohibited.

Lumicroma shall take legal action in the case of improper use and reproduction of the contents of its website, as well as misrepresentation, truncation and manipulation by bad faith of the information contained therein.

Lumicroma may, at any time and without prior notice, alter, suspend or discontinue any content without any obligation to compensate any third party. Amendments to the contents will produce their effects after the respective availability on the Website.

The conditions and terms of access to the IN COLORS PROJECT initiative on this website are defined in the Rules, and are also subject to these terms and conditions, as well as the privacy policy.

All copyright and intellectual property rights over the contents and Website belong or are licensed to Lumicroma, and the copyright of Lumicroma and its service providers, suppliers and/or collaborators are protected by Portuguese and European legislation.

Lumicroma's corporate names, trademarks, logos or any other distinctive signs reproduced on the Website are protected under the terms of the legal provisions applicable to industrial property. The reproduction or representation of all or part of any distinctive signs is strictly prohibited and must be subject to prior written permission from Lumicroma or the owner of the trademark displayed on the Website.

The lumicroma.com website collects name, telephone contact, email, and more professional elements, of each user who wishes to submit content for the purpose for which the Website is intended.

Lumicroma shall use such data in the terms defined in these conditions, in the privacy policy and also in the terms defined in the Rules of this initiative.

Lumicroma will store such data for the duration of the present initiative, and under the terms and conditions defined in the Privacy Policy and the INC Rules.

Lumicroma does not guarantee, in any way, to the user that the content, products or services available on the Website meet or are able to meet the needs and expectations of the same, and/or that any error existing in the software of the Website will be compulsorily corrected, noting also that no advice or information available on the Website shall create any warranty not expressly provided for in these Conditions.

Lumicroma also does not guarantee that the Contents are free from inaccuracies, lapses or typographical errors.

Insofar as the Website configures a public electronic communications network capable of use by several users and may be exposed to computer traffic overloads, Lumicroma, to the maximum extent permitted by law, shall not be liable to the user for:

a) Any damages suffered by the user and third parties, resulting from the impossibility of the use of the contents and Website due to delay, errors, suspensions and subsequent loss of information originating in facts outside the control of Lumicroma and not attributable to it, including any failures caused by communications networks provided by third parties, connection software and any computer viruses;

b) Any losses suffered by users and third parties which may arise from faults in the collection, display or use of contents, not attributable to Lumicroma or as a result of unauthorised use of Lumicroma's servers;

c) The correctness, timeliness or veracity of the information contained in the contents, as well as any errors, deficiencies or inaccuracies of these and the consequential damages.

Should any of the provisions of these Conditions be declared null, ineffective or annulled, this shall not affect the validity or effectiveness of the remaining clauses, which shall remain in full force and effect.

Portuguese Law shall apply to all matters governed by these Conditions.
In case of doubt about any content included on this website, in the absence of any additional clarification or some information that the user considers doubtful, improper or unlawful, should contact the team Lumicroma, through the address info@lumicroma.com.

In the event of any judicial dispute, in the interpretation or application of these conditions and also in the interpretation and execution of contracts concluded through the website, Portuguese law shall be the competent law and the district court of Oporto shall also be competent, with the express renunciation of any other.
